1. Problems that are intended to be resolved with the initiative and need and opportunity for its approval.
The territorial framing of Sitges is determined by two basic features, the proximity to the metropolitan area of Barcelona and the location on the coast. These two geographic factors largely explain the evolution and characteristics of the housing sector over the last decades. On the one hand, Sitges has received an important residential flow from the metropolitan area of Barcelona, although with less intensity than other neighboring municipalities; but on the other hand it has been able to play a very important role as a coastal tourist destination based more on quality than quantity. This duality of metropolitan transfers and quality tourist demand explain the distinctive features of the property market of Sitges, which are very difficult to find in the rest of the Catalan territory.
The current situation in the real estate market causes many people and families to have important problems of access to housing. This problem is particularly intense in the case of the younger population, pensioners, single-parent families, people with family responsibilities, women victims of gender-based violence or people with disabilities. There is also a group of Sitges who, due to the market prices of our municipality, had to look for residence outside the municipality, away from their family and social environment.
The Municipal Register of applicants for housing with official protection of Sitges is wanted, as an administrative registry for the best provision of the service of general interest that constitutes the provision of housing with official protection to the population with difficulties to access -his
The Registry must be a legal instrument to achieve efficient use of public resources and adequate management of the housing park with official protection, through efficient public control in its award and transmission.
On January 17, 2019, the Plenary Session of the Corporation, in extraordinary session, unanimously agreed to the development of housing policies in the municipality of Sitges, through the call for public tenders in various actions. One of them was to order the update of the Regulation of the Register of Public Housing Applicants in the municipality of Sitges, as well as the preparation of the Regulations for the awarding of official protection houses and the municipal supplementary regulations that, where appropriate, starting the pertinent inquiries between the citizens.
With this purpose, a study commission was created in accordance with article 163 of the Municipal Organic Regulation and article 62 of Decree 179/1995 of June 13, which approved the Regulation of works, activities and services of local entities, with the purpose of drafting the text of the preliminary draft regulations.
To this end, this Regulation is a response, a manifestation of the legislative power of the Municipal Administration, in the exercise of the municipal powers established in the field of housing.
2. The objectives of the norm.
The purpose of the regulation is to create and regulate the Register of applicants for housing with official protection of Sitges, with the following functions:
a. Provide information to the City Council of Sitges about the housing needs with official protection of the residents of the municipality.
b. Provide useful and reliable information to establish indicators of gender, age, origin and characteristics of households.
c. Provide information of the users of the existing housing park with official protection to the municipality.
d. Allow transparency in the management of housing parks with official protection in the municipality.
e. To establish the operational base for the allocation of housing with official protection to the municipality, established in the current regulations.
According to the proposed regulation, all those who wish to opt for an official protection house must register in the Register.
Once registered, they will be able to participate in the processes of adjudication of the public promotions, those applicants who fulfill the requirements demanded in the specific call of each promotion. In these announcements the economic scales and other necessary requirements for the participation in the allocation of the public housing lot, object of the announcement will be specified. To be part of a process for the award of a promotion, the application for housing promotion must be submitted.
The register of applicants of HPO in Sitges will share a common minimum file in accordance with the provisions of the decree regulating the Register of Applicants for Housing Protection of the Official of Catalonia, in order to facilitate the information and avoid the eventual fraudulent registration of one person in more than one municipality.
3. Possible alternative solutions, regulatory and non-regulatory.
The alternative is the maintenance of the current "Regulation of the Register of applicants for public housing in the municipality of Sitges", which through this initiative proposes to repeal and replace with a new "Regulation of the Municipal Registry of applicants for" houses of official protection of Sitges ", with the aforementioned purposes.
Another alternative, obviously, would be the creation or regulation of the Register of applicants of our municipality and address those interested in this type of housing in the Register of applicants for housing with official protection of Catalonia. However, this option would imply not being able to establish any specific requirement of the housing applicants in our municipality, which would try to define the recipient's profile properly, in order to adapt it to the specific circumstances or problems that our citizens find. when it comes to accessing the home.
Likewise, this alternative of non-regulation of the Registry would imply that, under the provisions of article 29 of Decree 106/2009, of May 18, it was the Generalitat de Catalunya that applied the general procedure regulated for the award of housing with official protection promoted in Sitges.
